Samantha has been a lawyer since 2001 having followed in the steps of her father, grandfather, great-grandfather and great-great-grandfather. No one can say she didn’t know what she was getting into!
Initially admitted in 2001 as a solicitor in NSW and Australia, Samantha moved to the UK where she was admitted as a solicitor in England and Wales in 2002. After working in several different areas of the law in large London firms, she determined that family law was her calling and hasn’t looked back.
Samantha has been back in Newcastle since 2016 and has since completed her Master of Applied Law (Majoring in Family Law) ensuring that her legal knowledge is comprehensive and completely up to date.
Samantha thrives on taking people from what is sometimes one of the most vulnerable and stressful moments in their lives through to being able to plan and see a happy future ahead of them.
Outside of work Samantha has a husband, three daughters and a dachshund named Keith. They keep themselves busy in the outdoors and particularly enjoy holidays in their VW campervan.
Thanks Sam,
You were actually referred to me by one of your previous clients. Just goes to show how strong word of mouth is, especially in this town. There are now even more people running around Newcastle saying what a terrific job you do.
From my perspective, you are light years ahead of the competition. It is so good to see a professional with such great customer service, who can communicate in a calm clear manner, especially when I am usually a bit emotional. ☺
Keep up the good work Sam, I look forward to continuing to work with you on my matter.
Regards
Thanks Samantha,
I’m still feeling a little shell-shocked but slowly getting used to the idea that it is nearly all over.
Thank you for all your support – professionally and emotionally. It was a big day and I was glad you were with me throughout the entire process,
Good morning Samantha
Thank you very much for your advice and support during the last 2 years. I am pleased to have settled the matter. It's appreciated and I will highly recommend you.
Thanks again
Family Law & Divorce FAQs
What type of lawyer is best for divorce?
The best lawyer for divorce is an experienced family lawyer – because divorce and separation are the main areas they are focused on. They understand the legal requirements for separation, property division and parenting matters, and will help you to reach agreements with your former spouse or partner through negotiation, mediation, or court if there are no other possible options.
How much will a family law matter cost to finalise?
Legal fees vary depending on the nature of your family law matter, the way it is resolved and which lawyer you work with . A simple divorce will cost a lot less than a disputed property division or high-conflict parenting matters. We offer a free 15 minute consultation to understand your matter, and can provide transparent costings from here.
We’ve also partnered with JustFund, who can assist with legal fees for some people who are going through property settlement without having access to upfront funds. You can also learn more in our article – costs before your divorce, or get in touch with our Newcastle family law team for advice relevant to your individual circumstances.
What's the best way to make parenting arrangements?
The best approach to parenting arrangements is open communication with your ex-partner, or, if needed, using Family Dispute Resolution, Mediation or working with a trusted family lawyer who can negotiate on your behalf. Once you’ve reached an agreement, our experienced family lawyers can guide you in drafting agreements that meet legal requirements and focus on the best interests of your children.
How is property settlement organised?
Property settlement usually involves negotiation between parties, often with legal representation from family law solicitors. If agreement isn’t possible, You may need to apply to the Federal Circuit and Family Court of Australia to have a decision made for you. The court will weigh up each parties contributions (financial and non-financial), income and financial resources, current and future needs and decide how to divide the property, in line with section 79 of the Family Law Act 1975 (Cth)
Are there time limits for property settlement?
Yes there are, and it’s important to seek legal advice early in separation if you are planning on making a property settlement claim. In Australia, you have 12 months from the date of your divorce order, or two years from your separation date if you are leaving a de facto relationship, to apply for property settlement. Missing this deadline can affect your legal rights, so seeking advice from a divorce lawyer early makes all the difference.
Is court necessary for parenting or property matters?
Court isn’t necessary in most cases. Many family law cases are resolved through negotiation or mediation, or with the help of a family lawyer. However, if parties cannot agree on parenting or property division, attending court may be required.
How is child support decided?
Child support is usually decided based on a formula that considers both parents’ income and care arrangements by Services Australia (formerly known as the Child Support Agency). These agreements do not take into account either party’s unique expenses or financial resources beyond taxable income. Our Newcastle family lawyers can help to create private child support arrangements and to ensure child support agreements are fair and comply with federal guidelines.
Do I need to update my Will when I divorce?
Yes, it’s important to update your Will after a divorce, as divorce can revoke previous provisions. An experienced family law solicitor or estate lawyer can help ensure your Will reflects your current wishes and protects your financial future following a divorce or separation.
